Wisconsin Elections Commission, Dane County Circuit Court

A Dane County judge this week refused to block a Wisconsin Elections Commission rule that bars voters who mailed an absentee ballot from casting a provisional ballot at the polls if they fear it will arrive late. Wisconsin counts only mail ballots received by 8 p.m. Nov. 3, with no grace period. After the April election, 336 late ballots were rejected in Milwaukee and more than 100 in Fond du Lac, and 67% of clerks reported mail delays. The League of Women Voters can still seek summary judgment, but a ruling would likely come after the midterms.
