What the levels mean

Level 1
Conditions forming. Claims, legal moves, or orders that could be used to justify interfering. Nothing has been stopped yet.
Level 2
Interference underway, process holding. It has happened in one or a few places (a seizure, a refusal to certify, a court order), but voting, counting, or certification can still go ahead on schedule.
Level 3
Process blocked. Widespread or disruptive enough that voting, counting, or certification can’t go ahead on schedule, or eligible voters are kept from voting.

It has sued 24 states and DC for refusing, plus Fulton County, Georgia for 2020 election records. DOJ cites the Civil Rights Act of 1960, which requires it to state the basis and purpose of a request. Dismissing the California case, the court said DOJ representations elsewhere painted a starkly different picture from its stated purpose. FederalU.S. Department of JusticeFederal election monitoring is long standing, run under both parties, and exists to enforce federal voting law. What we track here is scale and direction. By its last primary stop on September 9, DOJ said it had monitored polling sites in eleven states and hundreds of locations this primary season, against nine states in the 2022 midterms. DOJ says it will continue through the general but has not named November 3 jurisdictions. Context: the same division is suing 24 states over voter rolls, and CBS reported in March that the White House weighed defunding the civil rights observer program.
